Please read these terms carefully before using our services or website.
Parties: AV Luxury Vacations LLC ("Agency") and Travelers ("you"). By engaging our services or making any booking, you agree to these Terms.
You must: read and understand these Terms and your Trip Plan; contact Agency sufficiently before travel; confirm written acceptance; make all deposits per schedule; review travel warnings via U.S. government sites; and comply fully with all obligations. You warrant you are 18 or older and have authority to accept Terms for all household Travelers.
Suppliers operate independently from Agency. Agency assumes no responsibility for Supplier breaches, law violations, or negligent acts causing delays, damage, loss, injury, or death. All Suppliers have separate terms governing their services. Violations of Supplier terms may result in denied access, cancellation, and forfeiture of payments.
You accept travel's inherent risks. Agency recommends comprehensive travel insurance. Declining insurance means you assume all financial responsibility for changes, cancellations, baggage delays, supplier defaults, medical costs, accidents, and emergencies. Insurance policies may exclude pre-existing conditions, pandemic-related interruptions, and certain risk locations or activities. Agency holds no liability if insurers deny claims.
Your information may be shared with Agency, Suppliers, and third parties to accommodate travel. You consent to this distribution. Information includes birth dates, passport numbers, travel dates, frequent flyer info, and bank or credit card details. Agency has no liability for third-party information handling or protection failures.
Quoted prices reflect stated inclusions only. Unless itemized in Trip Plan, prices exclude: government fees (airports, customs, visas, passports); meals, beverages, alcohol; entertainment; seat assignments; upgrades; excursions; gratuities; telecommunications; laundry; parking; insurance; transfers; medical treatment; vaccinations; or personal charges. Supplier prices and availability change without notice until full payment. Even after full payment, you agree to pay variable fees beyond Agency control, including fuel surcharges.
You must make full payment per Trip Plan schedule. Failure to pay by due date may result in: price increases, fees, penalties; Supplier-initiated cancellations; Agency-initiated cancellations; and loss of non-refundable deposits. Re-Booking assistance is available, but Agency may charge non-refundable re-booking fees. Currency conversions use then-current exchange rates.
By submitting your card, you confirm authorization to charge it per Trip Plan dates. You are responsible for: incorrect card numbers; declined charges; insufficient funds; closed or expired accounts. Agency may suspend or cancel Bookings without refund obligation for card issues.
You waive rights to initiate chargebacks except for fraud. Before initiating any chargeback, address matters directly with Agency in writing. Initiating invalid chargebacks obligates you to reimburse Agency's dispute costs, including attorney's fees. This clause survives termination.
You must comply with Supplier cancellation terms. Suppliers may not allow refunds for changes, cancellations, partial use, or non-use due to health matters, pandemics, weather, terrorism, or political unrest.
Changes or cancellations incur: USD $250 Agency fee plus Supplier fees and penalties.
Commission Reimbursement: In the event a trip is canceled for any reason after supplier payments have been made, and AV Luxury Vacations LLC receives a commission that is subsequently recalled, withheld, or deemed non-recoverable by the supplier, you (the client) agree to reimburse AV Luxury Vacations LLC for the full amount of that commission. This obligation applies regardless of travel protection purchase or insurance claim denials. This clause survives termination.
Failure to travel results in penalties equaling up to the entire travel costs per Supplier and Agency terms.
Hotel availability is subject to reservation timing. Some hotels require non-refundable, non-transferable deposits. Amenities are not guaranteed and may be unavailable. Hotel refunds for unavailable amenities are the hotel's responsibility.
Airlines may require full ticket payment at Booking. Tickets are often non-refundable and non-transferable per Supplier terms. Name changes may be considered cancellations. Agency is not responsible for airline-imposed fees, seat assignment changes, losses, injuries, accidents, errors, schedule changes, delays, cancellations, or weather or operational expenses.
You are responsible for damage or loss you cause and must pay Suppliers directly. Any Authorized Party may refuse you any Travel Service, require you to leave, or require you to disembark if you are a danger to yourself or others, or engage in misconduct. Removal results in you bearing all subsequent costs and forfeiture of all refunds.
Notify Agency in advance if you have disabilities requiring special services or accommodations. Agency makes reasonable efforts to arrange services but is not responsible if Suppliers fail to meet expectations.
Notify Agency in advance of Food Allergies. Each Traveler with Food Allergies acknowledges the possibility of elevated risk and has sole responsibility for managing their Food Allergies during travel.
You assume all risks, costs, losses, and liabilities from Risk Activity and release Agency from all related liabilities. Risk Activity includes any inherently dangerous activity or location potentially causing property damage, injury, disability, illness, or death.
You bear all responsibility for well-being and treatment costs if illness or injury occurs. You release Agency, Suppliers, and other Travelers from related liabilities.
You are solely responsible for baggage and personal items at all times. Agency is not responsible for damage, loss, delays, or related matters.
You are responsible for determining, acquiring, and possessing required documents. NO REFUND will be issued for any costs or losses incurred as a result of Traveler's failure to obtain or possess any required passport, visa, or medical documentation. U.S. citizens need valid passports valid for six months beyond return.
You are solely responsible for pandemic and epidemic compliance. You warrant that you have reviewed and will continually check CDC and U.S. Department of State travel advisories. Countries may require testing and quarantine upon entry and return.
You are responsible for knowing and complying with jurisdiction laws regarding restricted materials. Drug possession or use may result in immediate service termination, detainment, prosecution, and incarceration.
You are responsible for knowing and complying with jurisdiction hazmat laws. Federal law prohibits hazardous materials in baggage or on persons. Violations carry up to 10 years imprisonment and significant fines under 49 U.S.C. 5124.
Agency arranges Travel Services provided by independent Suppliers. Agency has no liability for any claim of damage or loss arising from any act or omission, negligent or willful, of any Supplier, Traveler, or other third party. Agency has no liability for indirect, incidental, consequential, punitive, special, or exemplary damages. If awarded damages, they are limited to total commissions Agency collected.
AV Luxury Vacations LLC makes every reasonable effort to provide accurate, up-to-date, and factual information regarding travel suppliers, accommodations, amenities, services, and destination details. This information is based on data supplied by third parties and Agency cannot guarantee accuracy.
You agree to indemnify and hold harmless Agency, its owners, directors, employees, contractors, agents, representatives, advisors, successors, and assigns from all claims, damages, costs, and attorney's fees arising from your Terms breach or your negligent or willful acts or omissions. This survives termination.
No failure or delay in performance will be a breach if it arises from a force majeure or cause beyond the reasonable and foreseeable control of Agency, including: acts of God, floods, weather, fires, explosions, accidents, war, terrorism, sabotage, insurrection, riots, strikes, pandemics, epidemics, quarantines, government interventions. Agency provides no refunds for force majeure-caused delays.

Accessing or using the Website means you consent to information collection, use, and disclosure per this Privacy Policy. You may withdraw consent anytime by notifying asriel@avluxuryvacations.com.
Agency uses information to: verify identity; send emails; provide customer service; conduct marketing analysis; contact about services and offers; provide and maintain Website; analyze usage; and investigate illegal activities or fraud.
Agency won't transfer, rent, or sell information without notice. Information may be disclosed to: subsidiaries, affiliates, and service providers; legal process responses; merger, acquisition, or similar transactions; and professional advisors, law enforcement, and government organizations when necessary.
No method of electronic storage or transmission over the internet is 100% secure. While Agency strives to use commercially reasonable means to protect your information, Agency cannot warrant or guarantee your information will not be accessed, disclosed, altered, or destroyed.
Agency uses cookies and web beacons to improve experience, customize content, provide social features, and analyze traffic. Browsers allow deleting cookies or rejecting them entirely. Blocking cookies may impair Website operability. Google may use DART cookies for advertising per their privacy policy at https://policies.google.com/technologies/ads.
Website is not for users under 18. Agency does not knowingly collect personal information from users under 18.
EU residents have rights to: access stored personal data; amend or erase data; restrict processing; object to processing; data portability; withdraw consent; and submit supervisory authority complaints. Exercise rights by contacting asriel@avluxuryvacations.com.

These Terms apply to Website users and create a legally binding agreement. Rejecting Terms means not using the Website. Using the Website confirms you are over 18 and agree to these Terms.

Company is not liable for direct, indirect, incidental, consequential, special, exemplary, or punitive damages. Your sole remedy is ceasing Website use.
You agree to indemnify and hold Company and affiliates harmless from proceedings, expert and attorney fees, arising from your acts, omissions, content, or violations of these Terms or third-party rights.
Texas laws govern exclusively. Unresolved disputes after 60 days go to exclusive state or federal Dallas County, Texas courts. Neither Party challenges forum non conveniens.
